These Terms of Use ("Terms") govern your access to and use of the website, services, and online payment platform operated by Alpha Brothers Towing ("Alpha Brothers Towing," "we," "us," or "our"). By using our website, requesting our services, or submitting a payment online, you agree to be bound by these Terms. If you do not agree, please do not use the site or our services.
1. Services Offered
Alpha Brothers Towing provides light, medium, and heavy-duty towing, roadside assistance (jump-starts, lockouts, fuel delivery, tire changes), accident recovery, and related transport services in Sacramento, California and surrounding areas. All services are subject to availability, road conditions, applicable law, and operator discretion.
2. Service Requests & Quotes
- Quotes provided by phone, text, or website form are estimates based on the information you give us.
- Final pricing may change based on actual vehicle weight/size, distance, equipment used, on-scene conditions, wait time, and any additional services performed.
- You must be the legal owner of the vehicle, or have the owner's permission, to authorize a tow or roadside service.
- You agree to provide accurate location, vehicle, and contact information so we can dispatch safely.
3. Online Payments (Stripe)
We accept online payments through Stripe, Inc., a PCI-compliant third-party payment processor. By submitting a payment on our website, you represent and agree that:
- You are the authorized cardholder, or you have the cardholder's express permission to use the card.
- The billing information you provide is accurate, current, and complete.
- You authorize Alpha Brothers Towing to charge the card for the amount displayed at checkout, including any applicable taxes, fees, or surcharges disclosed before submission.
- The driver's license photo and electronic signature you submit serve as authorization for the charge and may be used to dispute fraudulent chargebacks.
- Card data is transmitted directly to Stripe over an encrypted connection. We do not see, store, or process full card numbers.
- Stripe's processing is governed by the Stripe Services Agreement and Stripe Privacy Policy.
4. Payment Authorization & Recurring Charges
Charges are one-time and only processed for invoices issued to you by Alpha Brothers Towing. We do not enroll customers in recurring or subscription billing without explicit written consent. Any pre-authorization holds placed at the start of a service (for example, on long-distance or storage jobs) will be settled to the final invoice amount once the work is complete.
5. Refunds, Disputes & Chargebacks
- Service fees are generally non-refundable once a truck has been dispatched or the service has been performed.
- If you believe you were charged in error, contact us within 10 business days at (916) 960-9499 or abtwng@gmail.com so we can review the charge before you initiate a chargeback.
- Approved refunds are processed back to the original card through Stripe and typically appear within 5–10 business days, depending on your bank.
- Chargebacks filed without first contacting us, or that are determined to be fraudulent, may result in a collections referral and recovery of dispute fees, legal fees, and storage charges.
6. Storage Fees & Unpaid Invoices
Vehicles left in our care are subject to daily storage fees disclosed at the time of tow. Unpaid invoices may accrue late fees, interest at the maximum rate allowed by California law, and may be turned over to collections. Vehicles unclaimed beyond the statutory holding period may be lien-sold in accordance with California Vehicle Code §§ 22850–22851.
7. Taxes
You are responsible for any sales, use, or similar taxes that may apply to your transaction. Where required, taxes will be calculated and added at checkout.
8. Customer Responsibilities
- Remove all personal valuables from the vehicle before it is towed when possible.
- Disclose any modifications, mechanical issues, low-clearance kits, aftermarket parts, or non-standard tie-down points before the tow begins.
- Stay in a safe location away from traffic while waiting for our driver.
- Provide accurate information; intentionally false information voids any liability we may otherwise have.
9. Limitation of Liability
To the fullest extent permitted by law, Alpha Brothers Towing is not liable for pre-existing damage, mechanical failures, items left inside the vehicle, or indirect, incidental, or consequential damages arising from our services or your use of this website. Our maximum aggregate liability for any claim related to a service is limited to the amount you paid for that specific service. Nothing in these Terms limits liability for gross negligence, willful misconduct, or any liability that cannot be excluded under California law.
10. Insurance Claims
Any claim for damage allegedly caused during a tow must be reported in writing within 48 hours of the service and accompanied by photos. Failure to report within this window may waive the claim.
11. Website Use
- You agree not to misuse the site, attempt to access non-public areas, scrape content, or interfere with security features.
- All site content, including text, photos, and our logo, is the property of Alpha Brothers Towing and may not be copied without permission.
- The site is provided "as is" without warranties of any kind, express or implied.
12. Third-Party Links
Our site may link to third-party websites (e.g., Stripe, Google Maps, Yelp). We are not responsible for the content, policies, or practices of those sites.
13. Governing Law & Disputes
These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute that is not resolved informally must be brought in the state or federal courts located in Sacramento County, California, and you consent to the personal jurisdiction of those courts.
14. Changes to These Terms
We may update these Terms at any time. The "Last updated" date reflects the most recent revision. Continued use of the website or our services after changes are posted constitutes acceptance of the updated Terms.
